This Privacy & Refund Policy outlines how Promoclub Services FZCO, trading as Magna Marketing (“Magna,” “we,” “our,” or “us”), collects, uses, stores, and shares your data, and defines the terms for refunds and lead replacements when using MagnaMarketing.io (“the Site”) or our services. By accessing the Site or working with us, you agree to the following terms.
1. Data Collection and Use
We collect personal and business information from users and clients to fulfill our lead generation services. This includes, but is not limited to: full name, phone number, email address, company name, investment preferences, IP address, location, device type, browser type, referral source, and CRM behavior. Data is collected through online forms, analytics tools, session tracking, and pixels.
The information you provide may be used to evaluate your inquiry, match you with relevant real estate partners, deliver leads to our clients, analyze advertising
effectiveness, and improve user experience.
2. Data Sharing and Confidentiality
Lead data submitted on MagnaMarketing.io is shared exclusively with one vetted client per lead and never resold or redistributed. Internally, data may be accessed by Magna staff and contractors strictly for operational, quality control, or reporting purposes. We do not sell your data to third parties.
Any sensitive information is stored securely on encrypted platforms, including CRMs and cloud services, with access restricted to authorized personnel only.
3. Data Rights
You have the right to access, correct, or request deletion of your personal data at any time. To do so, contact us at compliance@magnamarketing.io. Please note that once lead data has been delivered to a client, deletion will not affect historical usage, but further processing will be halted upon request.
4. Security
We employ physical, administrative, and technical safeguards to protect the confidentiality and integrity of your data. This includes SSL encryption, secure access protocols, multi-factor authentication, and routine audits.
5. Cookie Usage
We use cookies and similar technologies for analytics, advertising tracking, and retargeting. You can disable cookies via your browser settings; however, doing so may limit certain site functionalities.
6. Payment and Refund Policy
All payments for lead generation services are prepaid and final. Clients understand that fees are used to fund media spend, targeting, filtering, and qualification processes. Because resources are deployed immediately upon confirmation, refunds will not be granted except where outlined under our Lead Replacement Guarantee.
Refunds will not be issued in the following cases:
- The client fails to follow up with leads in a timely or professional manner
- The client requests a refund due to subjective preferences or internal changes
- The client changes targeting criteria after campaigns have begun
- The client does not provide proof for lead replacement requests
- The client initiates chargebacks or bank disputes without attempting to resolve the issue directly
7. Lead Replacement Guarantee
Magna offers a limited Lead Replacement Guarantee for leads deemed entirely unresponsive. To be eligible for a replacement, all of the following conditions must be met:
- The first contact attempt must be made within 16 hours of lead delivery
- The client must attempt contact via WhatsApp, phone, and email — with at least three separate attempts per channel, spaced out over 7 calendar days
- Timestamped screenshots of all contact attempts must be submitted via Magna’s Lead Replacement Form within 7 calendar days of delivery
- The lead must not have responded at all, in any form (e.g., seen, read receipts, callbacks, or replies)
Replacements will be processed within 3–5 business days for approved cases. Leads that fail to meet these criteria are not eligible for replacement or refund.
Repeated misuse of the replacement process or submission of falsified proof may result in suspension of the client account.
8. Use of Leads and Intellectual Property
All leads delivered are licensed to the client for one-time internal use only. Reselling, sharing, or redistributing lead data is strictly prohibited. All creatives, funnels, systems, and campaign structures remain the sole property of Magna Marketing unless otherwise agreed in writing.
9. Limitation of Liability
Magna Marketing is not liable for missed opportunities, sales performance, or unconverted leads. We do not guarantee ROI, meeting bookings, or closed deals. Our responsibility ends with the delivery of qualified leads as per agreed criteria.
10. Dispute Resolution
Any disputes related to services or this policy shall be resolved through binding arbitration at the Dubai International Arbitration Centre (DIAC). The prevailing party may recover legal and arbitration fees.
11. Governing Law
This policy and all related matters are governed by the laws of the United Arab Emirates. Jurisdiction shall be held in Dubai.
